Fallout 3 developer accuses original publisher of breach of contract, trademark infringement over stillborn MMORPG and selling Fallout games on Steam, GOG.com, and GameTap.

Three years after licensing the Fallout intellectual property in 2004, Bethesda Softworks bought it outright for $5.75 million from Interplay, which created the franchise. Under the terms of the deal, Bethesda licensed the rights to make a Fallout massively multiplayer online role-playing game back to Interplay, with the caveat the fallen publisher had to start full-time development within two years. Among Thieves officially finished; Sony announces series of movie theater parties in advance of October 13 retail debut.

Uncharted 2: Among Thieves is ready to set out in search of fame and fortune, Sony announced today on its official PlayStation blog. The sequel to 2007's PS3-exclusive Uncharted: Drake's Fortune, Among Thieves has wrapped development and will be ready for its planned October 13 debut at retail.

The NFL regular season kicked off last night, and believers in the Madden NFL cover curse already have something to point to. The Pittsburgh Steelers' Pro Bowl safety and Madden NFL 10 co-cover star Troy Polamalu suffered a knee injury in the second quarter of the season opener against the Tennessee Titans Thursday night.

The Associated Press reports that Polamalu's injury was diagnosed as a sprained medial collateral ligament (MCL), an injury that typically keeps pro players on the sidelines for three to six weeks. The defensive star had been having a productive game until that point, making six tackles and coming down with a spectacular one-handed interception earlier in the half. What we heard: Last month, federal documents surfaced which revealed Sony had tested a 250GB version of the PlayStation 3 Slim. This month, reports out of Europe have indicated the super-sized console could go on sale as early as October via a variety of game bundles costing £299.99 ($500) or €350 ($510).
